User agreement

This document (from now on called "Terms of use") is intended to regulate the use of the application that Euromedice, Ediciones Médicas, S.L. provides the user.

The intellectual property rights of the application, its source code, the databases and the various elements it contains are the property of Euromedice, Ediciones Médicas, S.L., which has exclusive rights to exploitation of the rights of the application itself and, in particular, those that relate to reproduction, distribution, public communication, maintenance and transformation.

The use of the application by a third party attributes this third party with the condition of user and assumes this user’s complete acceptance of each and every one of the provisions established by these Terms of use.

Proper use of the application

The user agrees to use the application, content and services in accordance with the Law, these Terms of use, good practice and public order. As such, the user undertakes not to use the application or the services provided through it for purposes or effects that are unlawful or contrary to the content of these Terms of Use, that harm the interests or rights of third parties, or that may damage, render useless or deteriorate in any way the application itself or its services or prevent satisfactory use of the application for other users.

Likewise, the user expressly undertakes not to destroy, alter, disable or, in any other way, damage the data, programs or digital and other documents that are found in this application.

The user undertakes neither to hinder the access of other users to the service through the mass usage of the computer resources through which Euromedice, Ediciones Médicas, S.L. provides the service, nor to take actions that damage, interrupt or generate errors in the aforementioned systems.

The user undertakes not to introduce programs, viruses, macros, widgets, controls of any kind or any other logical device or sequence of characters that cause or may cause any type of alteration in the computer systems of Euromedice, Ediciones Médicas, S.L. or third parties or, where appropriate, violate the rights of intellectual or industrial property.

The user agrees not to misuse the information, messages, graphics, drawings, sound and/or image files, photographs, programs and, in general, any kind of material accessible through this application or the services offered.

Euromedice, Ediciones Médicas, S.L., consequently, does not accept any liability arising from the damages that any visitor of this application may suffer on their technological resources (computer or telematic) as a result of the occurrence of any of the circumstances or facts mentioned in the previous paragraph. Similarly, Euromedice, Ediciones Médicas, S.L. does not guarantee that the application and the server are free of viruses and is not responsible for any damage caused when accessing the application or due to an inability to access it.

Euromedice, Ediciones Médicas, S.L. is not responsible for the information that can be obtained through links to external systems from this application.

Intellectual and industrial property

This application and all its contents, including texts, documents, photographs, drawings, graphic representations, databases, computer programs, as well as logos, trademarks, trade names and other distinctive signs are property of Euromedice, Ediciones Médicas, S.L. or third parties that have authorised it for its use.

Liability regime

Liability of Euromedice, Ediciones Médicas, S.L. for the use of the application:

The user is solely responsible for the infringements that may be incurred and the damages that they may cause or may occur to them through the use of this application. For its part, Euromedice, Ediciones Médicas, S.L. is exempt from any liability that may arise from the user’s actions.

The user will be solely responsible for any claim or legal action, judicial or extrajudicial, initiated by third parties against Euromedice, Ediciones Médicas, S.L. based on the use of the application by the user. In this case, the user will assume all expenses, costs and indemnities that are claimed from Euromedice, Ediciones Médicas, S.L. due to claims or legal actions attributed to it.

Liability of Euromedice, Ediciones Médicas, S.L. for the operation of the application:

Euromedice, Ediciones Médicas, S.L. does not accept any liability that may arise from transfers, omissions, interruptions, undesirable intrusions, telecommunications failures, computer viruses, telephone breakdowns or disconnections in the operation of the electronic system due to causes that are unrelated to Euromedice, Ediciones Médicas, S.L.

Liability of Euromedice, Ediciones Médicas, S.L. due to links from the application:

Euromedice, Ediciones Médicas, S.L. does not accept any liability regarding the information (content) (technical, moral or economic damages) that is outside the application and that can be accessed by a link from it, since the function of the links that appear is only provide information about a specific topic.

Commitment to data protection and compliance with the LSSICE [Information Society Services and Electronic Commerce Act]

In compliance with GDPR (General Data Protection Regulation), Euromedice, Ediciones Médicas, S.L. hereby informs users that the personal data they provide when using the forms or contract requirements will be collected in files under the responsibility of Euromedice, Ediciones Médicas, S.L. and will be processed in order to manage the registration and development in the functional program of the application and allow to provide and inform about the services or the products that Euromedice, Ediciones Médicas, S.L. offers. The completion of a form in this application implies that the user recognises that the information and personal data that they provide is theirs, accurate and true.

The registered user retains at all times the possibility of exercising their rights of access, rectification, opposition, deletion, restrict processing, portability or opposition to the processing of their data. Likewise, and in accordance with Law 34/2002, of 1 July, “de servicios de la sociedad de la información y comercio electrónico” [Information Society Services and Electronic Commerce Act], you may revoke the consent given to receive commercial communications at any time. Applicable legislation and jurisdiction

Any discrepancies arising in the interpretation or execution of these Terms of Use will be interpreted in accordance with Spanish legislation. In addition, Euromedice, Ediciones Médicas, S.L. through its legal representative and the user renounce any other jurisdiction and submit to the courts and tribunals of the user’s domicile for any dispute that may occur. In the event that the user is domiciled outside of Spain, Euromedice, Ediciones Médicas, S.L. and the user will submit to the courts and tribunals of the city of Barcelona.
